Terms of Service
I. General Definitions
- Terms of Service – this document regulating the rules of using the Service.
- Service – the “MakotoPD” online platform, available at https://makoto.com.pl/.
- Service Provider – the individual “Patryk Dąbrowski”.
- Service Recipient – any individual who gains access to the Service and uses the services provided.
- Electronic Communication – any exchange of information via e-mail and online forms available in the Service.
II. General Provisions
- The Terms of Service define the rules of operation and use of the Service, as well as the rights and obligations of both the Service Recipients and the Service Provider arising from the use of the Service.
- The subject of the Service Provider’s services is the provision of free functionalities of the Service, allowing Service Recipients access to content, audiovisual materials, web applications, or electronic forms.
- All information published on the Service (articles, tips, guides) is of a general nature and is not directed at specific Service Recipients. The Service Provider is not responsible for how they are used.
- The Service Recipient bears full responsibility for the use of the materials available on the Service and for using them in compliance with applicable law.
- The Service Provider does not guarantee the suitability of the materials published on the Service for specific purposes.
- The Service Provider is not liable for any losses or damages related to the use of the Service. All activities carried out by the Service Recipient within the Service are at their own risk.
III. Conditions of Use
- The use of the Service is voluntary and free of charge.
- Service Recipients are required to familiarize themselves with the Terms of Service and other related documents and to fully accept them if they wish to continue using the Service.
- It is forbidden to use personal data obtained via the Service for marketing purposes without consent.
- Technical requirements for using the Service:
- a device with a display capable of operating web pages,
- access to the Internet,
- a web browser compliant with W3C standards and supporting HTML5,
- enabled JavaScript support,
- enabled Cookie support.
- To ensure the security of all Service Recipients and the Service Provider, it is recommended to follow general Internet safety principles.
- It is forbidden to undertake actions, manually or using software, that result in:
- decompiling and analyzing source code without written consent,
- generating excessive load on the Service’s server without written consent,
- detecting vulnerabilities in the server’s configuration or security without written consent,
- uploading or injecting any malicious code, scripts, or programs,
- attempting to track or steal data from Service Recipients or the Service Provider,
- interfering with the operation of the Service in a way that prevents or hinders its use.
- In case of detecting a Cybersecurity incident or GDPR breach, the Service Provider must be informed immediately to enable a quick response and protection of the interests of all Service Recipients.
IV. Registration Terms and Conditions
- Basic use of the Service does not require registration.
- Full access to additional Service functionalities requires an account and login.
- Registration in the Service is voluntary and free of charge.
- Each Service Recipient may only have one account in the Service.
- Technical requirements for account registration:
- an active e-mail address.
- Registration constitutes consent from the Service Recipient for the processing of their personal data as entered into the Service during registration and during subsequent updates or deletions of data.
- The Service Provider reserves the right to suspend or delete accounts of Service Recipients if they violate the Terms of Service, engage in unlawful activities, or breach social norms.
- The Service Provider may modify the scope of services available on the Service, introduce new ones, temporarily suspend them, or restrict access at any time, at their own discretion, and without the need for Service Recipients’ consent.
- Additional account security rules:
- It is forbidden to share login credentials with third parties.
- The Service Provider will never ask Service Recipients for their password.
- Account deletion:
- A Service Recipient may delete their account in the Service at any time.
- Account deletion is possible after logging into the user panel.
- Account deletion results in the removal of the Service Recipient’s identifying data and the anonymization of their username and e-mail address.
V. Newsletter Service Terms
- A Service Recipient does not need to subscribe to the Newsletter to use the basic functionalities of the Service.
- Newsletter subscription is entirely voluntary and free of charge.
- Technical requirements for the Newsletter service:
- an active e-mail address.
- Conditions of providing the Newsletter service:
- providing a valid e-mail address via the electronic form,
- confirming the subscription by clicking the activation link,
- consenting to receive e-mail messages.
- The scope of the Newsletter service includes:
- information about new content, events, and promotions within the Service,
- information about promotional offers from the Service’s partners (marketing messages).
- Unsubscribing from the Newsletter:
- A Service Recipient may unsubscribe from the Newsletter at any time.
- Each Newsletter contains an unsubscribe link.
- After unsubscribing, the Service Recipient’s e-mail address is removed from the Service Provider’s database.
VI. Communication and Additional Services
The Service provides additional features and interaction tools, such as:

- Newsletter subscription system

All personal data provided when contacting the Service Provider is processed in accordance with the Privacy Policy, which forms an integral part of the Terms of Service.
Conditions for publishing content by Service Recipients within the Service:
- It is forbidden to post content that insults the Service Provider, other Service Recipients, or third parties.
- It is forbidden to publish text, graphic, or audiovisual content without having a license or authorization from the copyright owner.
- It is prohibited to post vulgar, pornographic, or unlawful content, as well as links to sites containing such materials.
- It is forbidden to post scripts, programs, or other files that place excessive load on the server or create security threats, as well as links to such resources.
- It is forbidden to publish marketing content or advertising for services, products, or commercial offers without the Service Provider’s consent.
VII. Data Collection
For legal and security reasons, and in order to provide services in compliance with the law, the Service collects and processes selected information about Service Recipients.
For optimal operation of the Service, we use cookies, which may store anonymous data about the Service Recipient’s activity.

VIII. Copyright

- According to the Act of 4 February 1994 on Copyright, simple press information is not protected. Such information may be used, provided that it does not constitute copying of a significant portion of the text without permission.
IX. Changes to the Terms of Service
- The provisions of the Terms of Service may be modified by the Service Provider at any time.
- Information about changes to the Terms of Service will be sent electronically to registered Service Recipients.
- For unregistered Service Recipients, changes take effect immediately upon publication on the Service.
- For Service Recipients registered before the change, the new provisions come into force 7 days after publication.
- Continued use of the Service after changes to the Terms of Service constitutes full acceptance of those changes.
X. Final Provisions
- The Service Provider is not liable, to the extent permitted by law, for content published by Service Recipients, including its accuracy and legality.
- The Service Provider makes efforts to ensure the Service operates continuously but is not liable for interruptions caused by circumstances beyond their control, including force majeure or third-party software.
- The Service Provider reserves the right to modify the content of the Service, including its functions and content, at any time without notifying Service Recipients.
- The Service Provider may temporarily disable the Service to perform maintenance, improvements, or for other justified reasons.
- The Service Provider reserves the right to permanently disable the Service without prior notice.
- The Service Provider may transfer, in whole or in part, the rights and obligations related to the Service to other entities without requiring Service Recipients’ consent.
